Terms of Service

legal relationship

The legal relationships between the dentist and the patient are of a private nature. In the case of treatment at the expense of health, IV and accident insurance, the corresponding statutory provisions of the respective care also apply.

Documents and Privacy

The dental documentation, in particular the patient files, examination results and other records are the property of ZurichDental. It is kept by ZurichDental for the patient and is only made available to the dentists and assistants treating them on their premises and is used for invoicing, collection (from Zaala AG, Creditreform) and patient information. The X-rays are the property of the patient, provided they have been paid for. Upon request, copies of the patient file and the original X-rays will be sent exclusively to the patient with regard to data protection. The retention period of the practice for patient files including X-rays is 20 years, after which dormant documents are destroyed in accordance with the data. Data from patients who book appointments online are loaded onto a protected server of Martin Engineering AG, Urdorf.

Missed Sessions

Agreed dental or dental hygiene treatment appointments are fixed appointments. The treatment times as well as the staff and the infrastructure are kept free for the respective patient alone. If the appointment cannot be kept by the patient, the practice has at least 48 hours, ie. at least 2 working days before the agreed appointment by telephone to inform them of their inability to attend. Appointments that are forgotten or not canceled in good time will be booked in accordance with the applicable tariff, Section 4014/4013 or 4.0140/4.0130 (missed session per 15 minutes at the dentist or dental hygiene) will be charged if they cannot be allocated elsewhere. Furthermore, the practice cannot assume the individual risk of failure of sudden illness or occupational disability for all patients. The costs for the missed session can usually be canceled on presentation of a valid medical certificate. You can cancel appointments outside of practice opening hours using the contact form on our website zurichdental.ch and by email info@zurichdental.ch up to 48 hours before the appointment in writing.

invoicing and dunning costs

Invoices are to be paid in full within 20 days of receipt. In the event of late payment, CHF 30 per reminder (2 reminders) will be charged after a free payment reminder. If payment is still not made, the case will be handed over to Creditreform or ZAALA. The fee is then an additional CHF 150. Data is then forwarded to the relevant authorities, insurance companies and courts.

installments

Monthly installment payments can be agreed if they are expressly requested before the start of treatment. An interest rate of 9.9% is charged on agreed partial payments. If the installment payment is delayed, the entire amount is due immediately.

guarantee and goodwill

According to the case law of the Federal Supreme Court, dental work in the legal sense constitutes an order in accordance with Art. 394 ff of the Swiss Code of Obligations. This means that the activities of the dentist must be based on the generally known and recognized rules of dentistry. This also means that the success of the treatment cannot be guaranteed. This regulation also applies in the area of dental care under social security law (e.g. UVG or KVG) and even if the insurance company issues instructions for the treatment of the patient. Malpractice occurs when the dentist clearly breaches his duty of care. This is the case if he neglects valid dental knowledge or ignores recognized rules of dental science. In unclear cases, such as material fatigue or premature aging of the restoration, the practice management will decide on a goodwill replacement on a case-by-case basis.

Use of photo and video recordings

Photo, X-ray and video recordings can be used anonymously for training and advertising purposes. If this is not desired, the box “I do not agree to the use of my recordings” can be ticked on the registration form when registering.
